South Haven Boating Accident

A South Haven boating accident has resulted in injuries to a boat owner and three passengers.  According to the Michigan State Police, owner Jim Fish was likely trying to refuel his yacht when a spark caused a fire and an explosion on board.  Jim Fish and passenger Anita Pryor are in critical condition while Keith Pepin is listed in fair condition.  Austin Pryor was treated for minor injuries and released.  Police are still investigating the accident.

This is a tragic accident.  Hopefully everyone involved is able to recover quickly and completely from their injuries.

My law firm frequently handles cases in which passengers on boats are injured.  Quite often, these cases are negligence cases.  The injured person will prevail in a negligence case if the defendant failed to use reasonable care while doing some activity and if that failure caused the person’s injuries.  In a boating accident like this one, the failure to use reasonable care could consist of refueling near sparks, improperly handling propone used on the boat for cooking, or doing anything else in an unreasonably dangerous way.  I often encounter clients who feel bad about suing their friends, but I always advise them that the suit is really against the insurance company that insures the boat.  Situations like this are exactly why boat owners pay to have their boat insured.
