Portage Hit and Run Car Accident Injures 5 Year Old
A 5-year-old Portage boy was seriously injured in a Portage Hit and Run Car Accident on May 5th. The boy was waiting for a school bus when he was allegedly struck by a car, according to Police. The driver fled the scene in a black colored car.
The child was taken to Bronson Methodist Hospital with a serious head injury and some minor injuries. Police are still investigating the accident and still searching for the driver of the vehicle. If you have any information that would aid the police in their investigation, please visit http://www.kalamazoosilentobserver.com/ or call the Portage police.
I am very sorry to hear about his accident and wish all the injured child a speedy and full recovery. Every parent’s biggest nightmare is their child being injured. School dropoff and pick up zones are always a major concern for student safety.
Michigan car accident victims have a number of legal rights. For this type of accident, the injured child can submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover medical expenses, attendant care, replacement services, and other benefits related to injuries suffered in the accident. The child can claim these benefits even if he did not have an automobile insurance policy and even if no one in his family had car insurance.
In addition, the injured child may be able to file a lawsuit against the person driving the vehicles. The insurance company for the drivers must still cover any injuries. In this lawsuit, the child can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.
If the driver’s identity is not discovered, the injured child still has rights under the law. The injured child may be able to file an uninsured motorists claim against his parents’ own insurance policy or another insurance policy to compensate the child for his or her injuries. It is important to have an experienced Michigan car accident lawyer review the policy to see if they can make such a claim.
An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.
