Kalamazoo County Roll-over Car Accident
I read an article today that reminded me of the imporance of using seatbelts. An Ontario woman and her infant were seriously injured after being thrown from their vehicle in Kalamazoo County Rollover Car Accident on I-94 on Monday, June 1st. According to police, an Ontario man was driving a 2001 Honda Civic when he allegedly lost control of the vehicle and hit the median causing it to roll three times. During the crash, the woman and the infant passengers were ejected from the vehicle. Police allege that the woman did not appear to be wearing her seatbelt and that the infants car seat was not properly secrured in the back seat. Both woman and infant were taken to a Kalamazoo trauma center with serious non-life threatening injuries. Police continue to investigate the Kalamazoo car accident.
I am very sorry to hear about his tragic car accident and wish all the woman and her infant a speedy and full recovery.
Michigan car accident victims have a number of legal rights. If the Ontario driver’s insurance was certified in the state of Michigan, then for this type of auto accident, the injured passengers submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.
In addition, the injury victims may be able to file a lawsuit against the driver in the auto accident. Even though one of the passengers is the child of the driver, the insurance company for the driver must still cover any injuries. In this lawsuit, the passenger can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.
An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.
