Train Accident Kills Group Home Resident

A 48 year old pedestrian was the victim in Washtenaw County Train Accident Death in Ypsilanti Township.  Police authorities believe that  the man wandered away from his group home onto to some train tracks and was struck by a train, killing him.

This is an absolutely tragic accident and I am very sorry to hear that this happened. My heart goes out to the family of the man for their loss.

I will be very interested as to how this accident investigation unfolds because it is important to know how and why this man was able to wander away from his home.  In many circumstances, group home residents must be under close supervision so that they do not wander away or leave the home.  The failure to properly supervise and monitor a group home resident can give rise to a Michigan lawsuit, especially when significant harm occurs as a result.  In cases involving death, family members can often file a Michigan Wrongful Death Lawsuit.

There are strict time deadlines for filing these types of claims and the failure to file them in a timely manner can destroy your case.  For more information about your rights after a Michigan accident, you should request our FREE book, “The Ultimate Guide to Injury Cases in Michigan” by clicking on the book link.  We will send it out immediately along with other important information

Clay Township Boating Accident

A fatal Clay Township boating accident has resulted in the deaths of three boaters.  The accident occurred when a vessel crashed into a dock on the North Channel of the St. Clair River in Clay Township.  One survivor, a woman from Ira Township, was pulled from the water by nearby witnesses and taken to the intensive care unit at the University of Michigan Hospital.  The three deceased boaters were taken to River District Hospital in St. Clair.

This is a very unfortunate tragedy and my sympathies extend to the families of these people.  I do hope that the surviving woman is able to pull through and experience a full recovery.

The survivor and the families of the deceased boaters may have a wrongful death claim against the owner or operator of the boat.  Although the families probably do not want to think about suing a friend, they should realize that this suit will actually be defended by an insurance company, which will pay any damages awarded in the case.  A successful wrongful death lawsuit could help compensate families for lost wages, for any medical expenses incurred because of the accident, and for the pain and suffering of losing a loved one.

Michigan Construction Accident Kills Worker

A Michigan construction worker was tragically killed yesterday when scaffolding from a construction project in Detroit unexpectedly collapsed.  Gilbert Danz of Roseville was working near I-75 between Grand Boulevard and Vernor Street when the accident occurred.  My sympathies go out to his man’s wife and three children.  There was no reason for this accident to have happened. My firm represents victims of injuries and their families in similar cases.  In investigating case similar to this one, it is important to determine all possible claims the family may bring.  Here the family will have a workers compensation claim against the worker’s employer.  They may also have a wrongful death claim if the scaffolding was negligently manufactured, installed, or maintained.  It is necessary to determine who was responsible for the scaffold and why it collapsed.

In a wrongful death case, the family can collect damages for loss of financial support based on the deceased’s lost wages, funeral expenses, and loss of childcare if the deceased helped care for his children.  The family can also collect damages for loss of companionship for the emotional trauma of his wife for losing the companionship of her husband and of his children for losing their father.

Zilwaukee Wrongful Death Lawyer

We often represent families and relatives of individuals who die as a result of an accident or the negligence of a business, a property owner, or another individual. When an unfortunate accidental or intentional death occurs, this may give rise to a Michigan Wrongful Death case. These lawsuits typically arise due to car accidents, motorcycle accidents, bus accidents, medical malpractice, dangerous and defective properties, recreational accidents, and work-related injuries.

Michigan wrongful death cases are controlled by the Michigan Wrongful Death Statute. This law determines who may file a lawsuit and how the court divides up a settlement or judgment. Attorney Daniel Buckfire was recently interviewed on wrongful death cases in Michigan and you can watch an excerpt of his interview below:

Like all other personal injury and accident claims, there are strict time limitations for filing a Wrongful Death Claim. Therefore, it is important to contact an attorney as soon as possible to protect your rights under Michigan law.
