Crawford County Drunk Driving Accidents

It was a bad week for Crawford County Drunk Driving Accidents. Crawford County deputies report that three seperate alcohol related car accidents occurred in one night sending a total of eight people tot he hospital. Accoirding to police, three people were airlifted to a hospital in Saginaw with serious injuries and another was taken to a hospital in Traverse City.

I am very sorry to hear about these incidents and hope that the injured people have a speedy recovery from their injuries. My heart goes out to the victims and their families.

Michigan car accident victims have a number of legal rights.  For this type of accident, the injured passengers can  submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accidents.  The injured passengers can claim these benefits even if they did not have an automobile insurance policy.

In addition, the injury victims may be able to file a lawsuit against the persons driving the cars.  In this lawsuit, they can claim damages and compensation for the injuries suffered in the accidents.  The insurance companies for the negligent drivers typically pay a settlement for this type of case.  Another possible claim would be a potential Michigan dram shop case against the sellers or furnishers of the alcohol before the accidents.

An experienced Michigan car accident lawyer can assist the victims with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent drivers before consulting with an attorney.

Highland Township Snowmobile Accident

A fatal Highland Township snowmobile accident may have been caused by alcohol.  David Lee Bills, 39, died on December 19, 2008 after his snowmobile crashed into a van on Duck Road.  Police believe David Bills was going the wrong way.  The driver of the van was unhurt but she was arrested for drunk driving.  Police believe David Bills may also have been drinking, but they are still investigating.

I am very sorry this accident occurred.  I want to extend my condolences to this man’s family.  I hope everyone remembers to use a designated driver, especially during the holiday season.

Because David Bills’ death occurred in an accident involving a motor vehicle, the Michigan No Fault Act applies and his family can collect No Fault insurance benefits.  A No Fault survivor loss claim would allow his family to collect a portion of the funeral cost and payments for loss of financial support (wages or salary) and loss of household services (payments for chores around the house).

In addition, the family should consult with a lawyer to determine if they can file a lawsuit for wrongful death.  To be successful, their lawyer would have to prove the driver of the van was negligent.  One important tool in helping the lawyer evaluate this is the police traffic accident report.  The family should get a copy of this report from the police station and speak with a lawyer.  A lawyer could also help them with their No Fault claim.

Michigan No Fault Lawyer | $3.5 Million Dollar Jury Verdict

A jury in Pontiac, Michigan delivered a $3.5 million dollar verdict against Auto Owners Insurance in a Michigan No-Fault lawsuit.  The case was heard in Oakland County Circuit Court Judge Kumar’s courtroom and involved a car accident that occurred in 1997, over eleven years ago.  The jury award involved benefits for residential care and included penalty interest.  Since the case was filed eleven years ago, the award also included pre-judgment interest from that time.

Pewamo Michigan Hit and Run Death

A 31 year old Pewamo man was killed last night in a Michigan hit and run accident.   Troy Ward died tragically after he was struck while walking on Hubbardston Road south of Stoney Creek Road while walking to a friend’s house.  The vehicle  did not stop and fled the scene.  Police are still investigating.

In such a case, the family of the decedent can file a claim for Michigan No-Fault insurance benefits.  These would include funeral bills and perhaps other benefits.  They can make this claim even if he did not have his own car insurance policy.  There may also be a claim for Michigan uninsured motorist benefits that can be made for a Michigan wrongful death claim. There are strict time limitations for making these claims and it is important that an experience attorney be contacted as soon as possible to investigate these claims.  My firm handles these matters on a daily basis throughout the State of Michigan.

Fruitport Michigan SUV Rollover Accident

A horrific accident was reported involving a Michigan SUV rollover accident that occurred in Fruitport Township, wich is located in Muskegon County.  All eight occupants of the vehicle suffered injuries after the driver of the vehicle and a front seat passenger were playing games with the steering wheel.  This caused the vehicle to swerve and then rollover, ejecting many of the occupants who were not wearing seatbelts.

This is truly a tragic accident that should never have happened.  This was not the result of driver error or unforeseen weather conditions, but rather due to horesplay behind the wheel of the car.  Additionally, the fact that the passengers, many of them children, were not belted makes this even worse.  Most of the children were at an age where they should have even been in car or booster seats.

The injured passengers have legal rights against the owner and driver of the vehicle.  The accident was clearly due to negligence in the operation of the car and the injury victims can seek money damages for their injuries.  They can also make claims for Michigan no-fault benefits to cover medical and other expenses.  If I was the attorney handling this case for an injured passenger, I would seek all available remedies for this senseless accident.
