Traverse City Nursing Home Abuse Lawyers

A Traverse City nursing home being investigated for nursing home abuse did not do enough to prevent the abuse, according to a report by the Michigan Department of Community Health.  The Tendercare Health Center-Birchwood facillity has had several incidents of resident on resident abuse and assault since 2006.  The state concluded employees of the facillity failed to stop attackers from exploiting vulnerable residents, especially older women with dementia or disabilities, from physical and sexual assaults.

I am very sorry this abuse has happened.  I think it is important to hold nursing homes and their employees accountable when they are complicit in this kind of abuse and neglect.

When a resident is abused or neglected in a nursing home, the victim or his or her family may be able to file a lawsuit against the nursing home or its employees.  A nursing home abuse case can involve incidents where a resident is injured through neglect by the employees themselves, such as when employees fail to move a disabled resident and severe bed sores develop, or a case can involve incidents such as this one where the employees fail to protect residents from aggression by other residents.  An experienced Michigan nursing home abuse lawyer could help evaluate a possible lawsuit.

Canterbury Castle Food Poisoning Suspected

The Oakland County Health Department is investigating a possible Norovirus outbreak at the Canterbury Castle in Lake Orion, Michigan.  Several events were held there on March 14, 2009, including a concert, a wedding, and a fundraiser.  Many of the attendees reported violent illnesses after the event.   Norovirus is a type of food poisoning that can be transmitted by a sick employee who comes in contact with the food or is simply ill around the food that is served to customers.

The investigation may take time to complete so that the health department can try to pinpoint the exact source of the Norovirus.  As a lawyer who has handled a number of Norovirus food poisoning cases, I can tell you that the illnesses described by diners is often very severe.  While many with the Norovirus suffer at home for days, others require hospitalization and testing.  Claims for personal injuries may be available to those who became ill once the health department investigation is completed.

Tuscola County Car Accident Lawyers

A Tuscola County car accident has resulted in the death of a Sandusky woman.  The accident took place on February 28, 2009 when a car going the wrong way on M-46 in Denmark Township caused an accident.  Lavonne Hendershot was killed in the car accident.  Her husband Timothy Hendershot and daughter were taken to the hospital for treatment.  So was the driver of the other car, John Wade of Saginaw.  Although it appears John Wade was the one going the wrong way, the accident is still under investigation.

I am very sorry this tragic accident happened.  I want to express my sympathy for Lavonne Hendershot’s passing and to say I hope the people injured in the car accident are able to recover.

When a family member dies in a car accident, many people want to sue the other driver.  Under Michigan law, they are entitled to file a lawsuit if the other driver was negligent in some way and this negligence caused the accident.  Here, going the wrong way down a major road is clearly being negligent.

What many people do not realize is that by rushing to file a lawsuit, they may be overlooking their right to file a claim with their insurance company.  This claim, for Michgian No Fault benefits, is sometimes even more important than a lawsuit, because No Fault insurance provides lifetime medical expenses for all reasonable and necessary medical treatment and pays lost wages for up to 3 years after the accident.  Because of this, I always recommend my clients file both a claim for No Fault benefits and, if they are entitled to do so, a lawsuit as soon as they can.

Toledo Car Accident Lawyer Rips Insurance Companies

Toledo personal injury attorney Dale Emch found out what happens when you criticize insurance companies. After writing a column in the Toledo Blade encouraging people to shop around for insurance policies that truly protect their families, insurance agents began attacking him. One went so far as to write a letter to the editor in The Blade that asserted that Dale not only was wrong, but was misleading the public. Fortunately for consumers, Dale was right. Some insurance companies still write policies that don’t contain intra-family exclusions. That means your family members will be covered for their injuries even if you caused an accident while they’re in your car.
