Sherwood Tractor Accident

A Sherwood tractor accident has left one man with severe injuries.  An employee of Spoor and Parlin Farm Equipment was seriously injured when he was working on a tractor and it somehow started and ran over him.  Athens Fire Rescue responded and ordered AirCare to evacuate the man by helicopter to a Kalamazoo hospital for treatment.  The Michigan Occupational Safety and Health Administration is investigating the accident.

I am filled with sympathy for this man and his family.  I hope he is able to have a full and speedy recovery.

My law firm represents people who have been injured in accidents such as this one.  Since this man’s injuries occurred at work, he likely has a claim for worker’s compensation, which will cover a portion of his wages and medical expenses.  He may also have a claim if another party is found to be negligent.  The best thing this man could do to determine the full scope of his rights is speak with an experienced attorney.

E-Coli Poisoning: Michigan State Students

Ten students at Michigan State University have been diagnosed with e-coli poisoning.  The Ingham County Health Department continues to investigate the poisonings to determine the source.  The ten students had similar symptoms and were admitted to the hospital and all are expected to recover.  If the source of the poisoning is identified, the sickened students may have a legal cause of action against the seller of the food that caused the illness.

Beaver Township Child Drowns in Standing Water

A 20-month old Beaver Township child drowned in standing water in the yard at his home on Tuesday.  Fire and Rescue responders performed CPR and transported the child to Mid-Michigan Medical Center in Midland but resuscitation efforts at the hospital failed as well.  This is a truly tragic death.  I feel terrible for the family of this child.

This incident stresses the importance of constant parental supervision of children around any type of water.  This is often an overwhelming task, especially when there are a number of children around and other major distractions.  Drownings happen very quickly in lakes, swimming pools, and even bathtubs and adults simply cannot let a child out of sight even for a minute.

Quite frequently, even highly trained lifeguards at swimming pools are distracted just long enough to miss a child struggling under the surface of the water.  For this any child safety groups recommend the use of personal flotation devices, like life jackets or vests, even in swimming pools and water parks.  This is, along with strict supervision, can reduce the number of child drownings and these tragic losses.

Farmington Hills Dog Bite Ordinance

Farmington Hills recently enacted a dog bite ordinance that threatens owners of vicious dogs and other pets with the label “dangerous animal.”  The ordinance establishes an Animal Review Board, which consists of the City Manager, Police Chief, and Fire Chief, or their designates, and which may include a veterinarian, animal behaviorist, and/or animal trainer.

A “dangerous animal” generally is one which has attacked or bitten a human being or domestic animal, or one which otherwise causes or threatens to cause serious injury to a human being or domestic animal.

If the Animal Review Board labels a dog or other animal as “dangerous,” its owners will be required to register the animal, post signs on their property, properly enclose the animal, and take the animal to obedience classes.  Most significantly, owners will also be required to carry a minimum of $1.5 million in personal liability insurance to cover any injuries caused by the animal.

Failure to comply with the ordinance is a misdemeanor.  Read the full text of the dog bite ordinance.

Calhoun County Michigan Nursing Home Abuse and Neglect Report

A Report on Nursing Home Abuse and Neglect for Calhoun County was recently released.  This report breaks the data down into several categories, which can be used to compare area nursing homes.  If you have a loved one in a nursing home or if you are facing the decision of placing a loved one in a nursing home, you will want to see how the home ranks.

It is extremely important to maintain quality care for our elderly population.  If your loved one has been the victim of abuse or neglect at a nursing home, you should report the facility to the proper authorities immediately and you should consult a lawyer to determine the extent of your legal rights.  The only way to make sure all our seniors are protected is to hold negligent facilities accountable.
